WASHINGTON (Reuters) ? The U.S. Justice Department is investigating accounting irregularities at Chinese companies listed on U.S. stock exchanges, said an official with the Securities and Exchange Commission, suggesting criminal charges may be brought in addition to civil proceedings.
"There are parts of the Justice Department that are actively engaged in this area," Robert Khuzami, director of enforcement at the SEC, said in an interview on Tuesday.
He told Reuters that a number of federal prosecutors around the United States were taking part in the investigation, but he declined to name them.
Involvement of U.S. attorneys general in various locations adds investigative firepower to the SEC and the Federal Bureau of Investigation, which are also probing the accounting methods of certain U.S.-listed Chinese companies.
"I think that you will see greater (Department of Justice) involvement as time goes on," Khuzami said when asked if criminal charges would be filed in the investigation.
A former federal prosecutor, he declined to elaborate on which Chinese companies or auditors were being scrutinized by the Justice Department.
An SEC review of accounting problems at foreign-based stock issuers sharpened its focus earlier this year when dozens of China-based companies began disclosing auditor resignations or book-keeping irregularities.
For example, Deloitte Touche Tohmatsu CPA Ltd in May resigned as auditor of Chinese software company Longtop Financial Technologies Ltd, saying it had found falsified financial records and bank balance confirmations.
Shares of some Chinese companies listed in the United States fell on Thursday after Khuzami's statements became public. Among them, Sohu.com Inc closed 4.7 percent lower at $50.62, Baidu Inc fell 9.2 percent to $110.29, China Sky One Medical Inc declined 3.8 percent to $2.29, and Sina Corp ended down 9.7 percent at $73.23.
The SEC has struggled to gain access to documents it needs in the investigation because strict Chinese laws have made auditors reluctant to turn them over.
The FBI has an embedded agent in an SEC working group on Chinese companies that enter the stock market through so-called reverse mergers with U.S. shell companies.
Officials from the SEC and the Public Company Accounting Oversight Board (PCAOB) are due to meet with their Chinese counterparts in Washington, D.C. in October for a second round of talks on joint inspections of auditing firms in China.
"Not having proper accounting and reliable audit review for publicly traded companies with operations in China is just not acceptable. We have to find a path to resolution of this issue," Khuzami said. "It is ... a big issue for us."
Earlier in September, the SEC sought a federal court order to force the Shanghai arm of Deloitte to turn over its work papers regarding Longtop Financial.
The results of the Deloitte subpoena enforcement action will be closely watched by other auditing companies, Khuzami said. The federal government is also pursuing other options to ensure better accounting practices at U.S.-listed companies based in China, he said.
"Obviously, the results here will inform the conduct of others that are similarly situated. In that sense, it's going to be instructive," Khuzami said. "At the same time, we're not a one-trick pony; There are other efforts to reach resolution of these issues. We continue to work closely with our regulatory counterparts in China and in other countries to find a path to resolution."
In a recent interview with Reuters, Assistant Attorney General Lanny Breuer, head of the Justice Department's criminal division, underscored the government's commitment to fighting accounting fraud of any kind. He declined, however, to comment on specific cases that could be brought against Chinese firms listed in the United States.
The Justice Department declined comment for this story, saying it does not confirm or deny investigations.
In any criminal case, the question would be whether the company lied to the auditor, or whether the auditor acted recklessly or knowingly in not detecting the alleged fraud.
Merely not providing records under these circumstances -- as in the Deloitte case -- would not likely rise to the level of criminal violation, Khuzami said.
The PCAOB, the agency that oversees auditors of public companies, has inspection authority over auditing firms, while the SEC has enforcement authority over those companies.
Together, the two agencies have greater leverage over auditing firms than do criminal authorities, Khuzami said.

Judge Rodion Kireyev on Friday adjourned the trial until Oct. 11 to deliver a verdict in the case.
Tymoshenko refused to make her final speech after Kireyev rejected her request to give her more time to prepare the speech. She insisted on her innocence and said the trial amounted to "lynching" by her archenemy, President Viktor Yanukovych.

HOUSTON (AP) ? At age 84, Elmer Pitchford knows time is running out for him to learn who killed his teenage daughter four decades ago in Houston.
"I would like to know before I die, that's for sure," he said.
But the retired dock worker said he's not sure what to think of claims being made by Edward Harold Bell, a 72-year-old Texas prison inmate who claims he killed nearly a dozen young girls found murdered in southeast Texas in the 1970s ? including Pitchford's 16-year-old daughter, Kimberly.
Part of him wants to believe that Bell had something to do with the unsolved murder, but he also thinks Bell may turn out to be a "kook." The aunt of another slain girl also expressed mixed emotions, saying it makes her question whether the suspect convicted in her niece's death was the right man.
Investigators said that while the Bell's claims aren't entirely new and were previously investigated, they are looking at them again after he told the Houston Chronicle he was responsible for the deaths of as many as 11 girls.
"The bottom line is Ed Bell has said these things (before). Is it fodder? I don't know. I've never been able to prove anything he has said," said Capt. Chris Kincheloe of the Brazoria County Sheriff's Office, which has four of the unsolved murders for which Bell is claiming or hinting responsibility, including Kimberly Pitchford.
Bell is serving a 70-year prison sentence for the 1978 killing of a Houston-area Marine who tried to stop him from masturbating in front of a group of girls. But in recent interviews with the newspaper, he described a string of cases from 1971 to 1976.
Bell claimed he killed four girls whose names he knew, all of them teenagers, including Kimberly Pitchford. He also described four other victims he said were killed in pairs, and gave incomplete information on three others. The cases involved girls who were between the ages of 12 and 19 and were taken from towns and rural roads in Brazoria, Harris and Galveston counties.
Investigators in those counties, prompted by Bell's claims to the newspaper, have said they are reviewing evidence in the mostly unsolved murders. Bell said he would provide proof to back up his claims ? but only if he's given immunity.
Capt. Jeff Heyse, spokesman for the Galveston Police Department, which is reviewing two of the unsolved murders, said he found it "interesting" that Bell wants immunity when he is already serving a life sentence.
"We're looking at where we can go from here," Heyse said.
The newspaper reported that prosecutors in Galveston and Harris County received letters of confession from Bell in 1998, but he never was indicted because detectives were unable to verify his claims or because of cost considerations related to cold-case investigations. Harris County prosecutors apparently lost copies of Bell's letters.
Prosecutors in Galveston did not return a telephone call seeking comment from The Associated Press, while the Harris County District Attorney's Office declined comment.
Kincheloe said he read the letter that Bell sent to Galveston prosecutors and found "there was nothing there that we could use in our cases." He said Brazoria County sent two investigators in 2008 to speak with Bell about two slain girls, but Bell wouldn't talk.
Kincheloe said he wonders if Bell "running a Lucas scam," in reference to serial killer Henry Lee Lucas, who told police he killed as many as 600 people but later recanted. Lucas died in a Texas prison in March 2001, after his death sentence was commuted.
"Several aspects of Ed Bell's story have been investigated in the last 10 years and I never found anything," Kincheloe said. "It's not like people have turned a blind eye and a deaf ear to Ed Bell. We just can't find anything."
But the convicted killer's claims did shock Dotti Walker, the aunt of 14-year-old Sharon Shaw, one of the young girls that Bell didn't name but could be tied to.
Walker, 77, said she was surprised because another man was convicted for her niece's murder, as well as the slaying of Shaw's friend, 14-year-old Rhonda Renee Johnson. The two girls were abducted in 1971 after going to the beach in Galveston.
Michael Self, a mechanic from suburban Houston, was convicted of the two girls' murders and died in prison in 2000. His attorneys said during appeals that Self was wrongly accused, and the Houston Chronicle reported earlier this summer that at least two investigators, a Galveston police officer and a former Harris County prosecutor, believed that Self might have been the wrong man.
Echoing Elmer Pitchford's sentiments, Walker said she hoped investigators would go back and talk to Bell but wasn't sure whether he should be given immunity.

HOUSTON - Prostate cancer survivors and their partners experience improved sexual satisfaction and function after couples counseling, according to research at The University of Texas MD Anderson Cancer Center. The article, published in the September issue of Cancer, a journal of the American Cancer Society, revealed both Internet-based sexual counseling and traditional sex therapy are equally effective in improving sexual outcomes. Couples on a waiting list for counseling did not improve.
Men experienced a marked improvement in their sexual function for up to one year, and women who started out with a sexual problem improved significantly with counseling.
"We know that one of the crucial factors in a man's having a good sexual outcome after treatment is a partner who also wants their sex life to get better," said Leslie Schover, Ph.D, a professor in MD Anderson's Department of Behavioral Science, lead investigator on the study and author of the paper, "A Randomized Trial of Internet-Based Versus Traditional Sexual Counseling for Couples After Localized Prostate Cancer Treatment." "Women's issues such as ill health, post-menopausal vaginal dryness and lack of desire for sex can be a major barrier in achieving satisfactory sexual outcomes."
CAREss (Counseling About Regaining Erections and Sexual Satisfaction) randomized 115 heterosexual prostate cancer survivors who were experiencing erectile dysfunction and their partners into three groups: a wait list group that received delayed counseling, a face-to-face counseling group, and a group that received an Internet-based sexual counseling program.
After three months, the wait-list couples were randomized into either the face-to face or the Internet-based counseling group. A second Internet-based group of 71 couples was added to boost the numbers and allow researchers to analyze the relationship between extent of website use and outcomes.
Couples were assessed before and after the three-month wait-list period, again after counseling, and also at six and 12-month follow-ups. In addition to web-based education and exercises, participants in the Internet-based group received feedback from their counselor through email.
Treating the Body and the Mind
Many prostate cancer survivors are as concerned about loss of desire and lack of satisfying orgasms as they are about erectile dysfunction. Men in this study improved on most dimensions of sexual function. From baseline to one year, men improved significantly in erectile function, but also in orgasmic function, intercourse satisfaction and overall sexual satisfaction. Sexual desire remained stable.
Some patients and/or partners are too anxious about sexual issues to seek help from a therapist face-to-face. An internet-based program that offers online tools and surveys, as well as interaction with the therapist by email, gives them a less threatening option. "Not only do men often use the internet to search for information on sex, but prostate cancer patients consider the web a valuable resource for information on the impact of treatment on sex," said Schover.
Another advantage of web-based counseling for couples is the potentially lower cost. While many insurance companies cover medical treatment of erection problems after prostate cancer, the cost of sex therapy is often not reimbursed. Already burdened with co-payments for their cancer treatment, many couples cannot afford additional costs associated with mental health care.
"Very few insurance policies sufficiently cover sexual counseling in particular, and mental health counseling in general," said Schover. "Another barrier is that there are few mental health care professionals trained to deal with both cancer coping and sexual problems."
The results from the CAREss study have already contributed to Schover's current research. She is developing a more general multimedia interactive counseling program to help men with any type of cancer and their partners improve their sex lives. She hopes this program will help men and couples with limited insurance or lack of access to a big city or cancer center.

In this study, Dr Jacqueline Hewitt and colleagues from the Royal Children's Hospital Melbourne, Australia, used whole genome mircoarray, and subsequently fluorescence in-situ hybridisation and bioinformatic analyses, to examine the genomes of 30 children with disorders of sex development (DSD). Nine patients had 46,XX testicular DSD (meaning that although they had XX chromosomes, they had developed as males with testicles), while 21 patients had 46,XY gonadal dysgenesis (meaning that although they had XY chromosomes, they had developed as females, without testicles).
In two of the patients with 46,XX testicular DSD, the researchers found a small region, outside of the SOX9 gene, which was duplicated. Bioinformatic analysis of this duplicated region indicated that it contained an SRY/SOX binding motif, meaning the region may be a regulator of SOX9 gene activity and thus involved in testicle formation. The tandem arrangement (i.e. one after another) of the duplications implies they have either a dosage-related or structural effect on the SOX9 gene. The position of these duplications ties in with previous research in patients with a similar condition, familial 46,XX testicular DSD, which also showed that this chromosome region may be involved in testes development.
These findings address key issues in the complex gene regulation system that controls human sex development, in particular the mechanism by which the SOX9 gene is upregulated and testicles are formed in the embryo. This new gene regulatory region appears to be a missing link in the testis development system, and it is significant that duplications in this region can initiate the development of testicles in a person who has XX chromosomes. Further studies are now needed to ascertain if testis development can be initiated by switching on this region in growing cells and in developmental animal models.
Researcher Dr Jacqueline Hewitt, from the Royal Children's Hospital Melbourne, Australia, said:
"We have known for a while that for testes to form in the embryo, a key gene called SOX9 needs to be activated. However, until now, the mechanism by which this activation occurs has been unclear.
"Our research indicates that there is a gene regulatory region on chromosome 17, upstream of the SOX9 gene, which is involved in the initiation of testicle development in the fetus. This regulatory region is sited a distance away from the SOX9 gene itself, but functions to switch the gene on, allowing the formation of testicles. This illustrates the fundamental importance of not just the actual genes, but also of gene regulation systems in human development. We are only now beginning to understand the mechanisms of gene regulation, which are essential for the development of a complex organism such as a human child. This research significantly advances our understanding of how the testes develop in the human body."

MOSCOW (AP) ? Russia's influential finance minister was forced out Monday following a televised confrontation with President Dmitry Medvedev, who had angrily demanded that Alexei Kudrin immediately explain his criticism of Medvedev's policies or resign.
The open conflict within Russia's leadership follows the announcement over the weekend that Prime Minister Vladimir Putin plans to return to the presidency next year and Medvedev would then take his old job as prime minister. Russia will have a presidential vote in March, but Putin is sure to win.
The departure of Kudrin is likely to unsettle investors and further shake Russia's markets. A longtime member of Putin's team, he has been finance minister since 2000 and his tight hold over the budget has been seen as key to Russia's economic stability.
"It is difficult to see how Mr. Kudrin's resignation can be anything but market-negative," said Neil Shearing, chief emerging markets economist at Capital Economics Ltd in London. "With oil prices starting to slide and financial markets still jittery, now is not a good time for the government to lose its arch fiscal hawk."
On Saturday in the U.S., Kudrin said he would refuse to serve in the government if Medvedev was made prime minister because of policy disagreements he had with him, including plans to substantially boost military spending.
Addressing Kudrin on Monday, Medvedev called the minister's remarks "irresponsible chatter" and "improper," especially since they were made while the minister was in Washington for meetings of the International Monetary Fund and the World Bank.
"If you disagree with the course set by the president and being implemented by the government, you have only one choice: Resign," Medvedev said during a meeting of a presidential commission on modernization held in the town of Dimitrovgrad.
Kudrin, who stayed in his seat, shot back that he would decide only after talking to Putin.
"You can seek the advice of whomever you want, but as long as I'm president, such decisions are made by me," Medvedev retorted.
The Kremlin said Medvedev signed a decree on Kudrin's resignation. State news agencies quoted Kudrin confirming that he had quit.
Kudrin has been widely credited with helping Russia weather the 2008-2009 global financial crisis. During Putin's presidency from 2000 to 2008, Kudrin stashed some of the revenue from Russia's soaring oil exports into a stabilization fund despite strong opposition from other ministers who wanted to spend the money. But when the financial crisis hit and oil prices sank sharply, those savings proved crucial in reducing the blow to Russia's economy.
Nikolai Petrov, a political scholar at the Carnegie Moscow Center, said Putin may have wanted to spare Kudrin from taking responsibility for the higher taxes and cuts in social spending that Russia faces after a parliamentary election in December and a presidential election three months later.
"Putin cherishes Kudrin too much to put him in the crossfire of unpopular measures," Petrov said.
The 50-year-old Kudrin had been mentioned as a possible future prime minister, and Petrov said Putin could still appoint him to the post sometime in the future.
Anton Struchenevsky, a senior economist at the Moscow-based investment bank Troika Dialog, described Kudrin as "the restraining element against populist policies" in Russia.
"All of Russia's macroeconomic achievements are Kudrin's work," Struchenevsky said. "Kudrin is a highly influential figure, and I don't see anyone of similar weight who could replace him."
Some market analysts speculated that Kudrin's departure could have a greater effect on Russia's economy than the 2012 presidential election itself.
"It is unlikely that Mr. Kudrin's replacement will share his predecessor's credentials and clout," Shearing wrote in a note to investors.

"In particular we have asked the NTC (National Transitional Council) to make available to the Crown any documentary evidence and witnesses which could assist in the ongoing inquiries," a spokeswoman for the Scottish Crown Office said.
Abdel Basset al-Megrahi, a former Libyan agent who was convicted of the bombing which killed 270 people, was released on compassionate grounds in 2009, but the Crown Office said his trial court had accepted he had not acted alone.
'Did not act alone'
"The trial court accepted that Mr. Megrahi acted in furtherance of the Libyan intelligence services in an act of state sponsored terrorism and did not act alone," a Crown Office spokesman said, according to BBC News.
"Lockerbie remains an open inquiry concerning the involvement of others with Mr. Megrahi in the murder of 270 people," he added. "The Crown will continue to pursue lines of inquiry that become available and following recent events in Libya has asked the National Transitional Council, through the Foreign and Commonwealth Office, for assistance with the investigation."

The spokesman said that it was not "appropriate" to comment further because the investigation "remains live."
Libya's country's transitional justice minister, however, told reporters on Monday "the case is closed." Mohammed al-Alagi said there was no reason to keep dragging the case into court.
Megrahi's co-accused at the specially convened Scottish court sitting in the Netherlands in 2000 was Al Amin Khalifa Fhimah, who was cleared of mass murder.
He told Sweden's Expressen newspaper last month that deposed leader Moammar Gadhafi should be tried in court over suspicions he ordered the bombing.
"There is a court and he is the one to explain whether he is innocent or not," Fhimah said. "He has to."
In March, Mustafa Abdel Jalil, Libya's former justice minister and now its interim leader, said he had evidence of Gadhafi's involvement in the bombing.
Last week, the U.S. ambassador to Libya returned to Tripoli to lead a newly reopened American Embassy in a post-Gadhafi era.

Ambassador Gene Cretz was nominated to be the first U.S. ambassador to Libya in 36 years by President George W. Bush in July 2007 after a remarkable turnaround in U.S. relations with the North African nation.
The seismic shift in ties followed Gadhafi's payment of compensation to the families of victims of 1980s terror attacks, including the bombing of Pan Am Flight 103 over Lockerbie. The dictator also renounced weapons of mass destruction in 2003.
That relationship evaporated amid the popular uprising against Gadhafi's regime this year, with U.S. and other NATO planes intervening to protect civilians from attacks by his forces.

"Wait," one of the rioters on 443 Lane urges. "Wait. OK, now." The gangs send a barrage of stones toward the police squad's white helmets and then scatter over alleyways and race into homes.
For months, scenes like this have defined Bahrain's Arab Spring unrest: mobs demanding equal rights for Shiites waging hit-and-run battles against security forces defending the Sunni rulers in the tiny Gulf kingdom. In size and fury, the confrontations might seem like little more than a Middle East sideshow in comparison with the far bloodier upheavals in Syria or Yemen.
But in compact Bahrain ? with protest hotbeds and loyalist bastions almost within shouting distance ? everything is amplified. On an island no bigger in area than New York City, majority Shiites and Sunnis backing the ruling dynasty are increasingly unable to find common ground or even agree on a general path toward dialogue.
Protesters are now raising the battle cry of reclaiming Pearl Square, the former hub of the 7-month-old rebellion that's now guarded as tightly as a military base. Security forces, meanwhile, are pushing back harder ? even arresting at least 45 women and girls last week on suspicion of stirring up anti-government dissident in one of Bahrain's main shopping malls.
If Bahrain tumbles toward greater confrontation, places such as 443 Lane will be the training grounds for both sides.
The short street ? jutting off a main road in the mostly Shiite neighborhood of Sanabis ? has been so often caught up in the street skirmishes that used tear gas canisters are collected and stacked in neat rows inside doorways. By late afternoon, the protesters usually begin to gather. Many are well-prepared for the expected tear gas: Wearing swimming goggles and surgical masks. Refrigerators in safe houses hold extra cartons of milk to wash away the burning residue on their faces.
Police appear to have orders to move in at the slightest whiff of a challenge.
And on this night, protesters were particularly anxious for a fight. Voting had just closed in special parliamentary elections Saturday. The voting was called to fill 18 seats ? nearly half the 40-seat chamber ? abandoned by Shiite lawmakers to protest the crackdowns that include deadly clashes and life sentences for some activists.
Shiite groups pressed for a boycott, which they say held turnout to only about 17 percent. Authorities tally it up differently ? portraying the new parliament as representing more than half the country's voters by combining the figures with results from last year's election.
This is part of the separate narratives that make Bahrain volatile and unpredictable.
Shiites claim they are stuck in a permanent underclass although they represent about 70 percent of Bahrain's 525,000 citizens. In their view, all the routes to power, such as high political or military posts, have been blocked by the Sunni leadership. "Welcome to Arab apartheid," read a message spray-painted in red in Sanabis.
Bahrain's Sunni rulers say their country is being pulled apart by rejectionist groups that have chosen violence over dialogue, including offers to allow parliament to vet government appointments such as the premiership. They also view the main Shiite political blocs as deeply conservative ? with ties to Shiite leaders in Iran and Iraq ? and a threat to women's rights and Bahrain's open economy.
The leadership's stance is hardened by the belief that Shiite power Iran is plotting ways to gain influence through the discord in Bahrain ? which could have ended up part of Iran if a U.N.-backed fact-finding mission in 1970 found majority support for annexation.
The fears about Iran also resonate strongly with Bahrain's allies. Neighboring Saudi Arabia led a Gulf military force that came to the rescue of Bahrain's monarchy in March. Washington has stuck by Bahrain's rulers to preserve crucial partnerships, including the base of the U.S. Navy's 5th Fleet. At some police checkpoints, the green Saudi flag flies alongside the red-and-white colors of Bahrain.
On 443 Lane, there are no nuances. The protest gangs see this as their Arab Spring moment that may not come again ? with many too young to remember the last serious street clashes in Bahrain in the 1990s.
But what they want is far less clear. They all denounce the stewardship of Bahrain's king, Hamad bin Isa Al Khalifa, yet have no alternative leader or plan to follow. The driving force of the moment appears to be trying to recapture the mass energy of Pearl Square during the first weeks of the revolt in February.
Authorities know this well. Checkpoints and pincer-style patrols are used to keep protesters mostly contained to their neighborhoods and unable to join forces.
When police moved down 443 Lane, the mobs were ready. First they showered the unit with stones and then took shelter behind metal trash bins overflowing with garbage. Officials have apparently slowed ? or halted ? trash collection in some areas as punishment for the clashes.
Police answered with tear gas.
"Run, run," the protesters yelled. "To the house. The door is open."
About a dozen protesters tumbled through a metal door into the house of a sympathizer. Moments later, the police patrol swept past.
One demonstrator, Ali, poured milk over his face to neutralize the stinging power of the tear gas. He then joined the others on the roof, where they passed signals to other protest sentries tracking the police movements. On cue, some protesters hiding in a pigeon coop rained stones down on the police ? whose ranks include officers from other Arab states and south Asia who are given citizenship under programs to boost Sunni Muslim numbers.
"We know these kinds of fights will not bring down the regime," said Ali, a 27-year-old construction worker who only gave his first name for fear of later reprisals. "But it sends a message that we are here and we will not rest. We feel we are under occupation by a system we no longer respect."
Ali made his way to Sanabis from an area about 10 miles (six kilometers) away, using an underground system of houses that provide shelter and food for protesters. Sanabis is less than a half-mile (one kilometer) from Pearl Square, but they know that it would take a protest army of thousands to break through the cordon of armored vehicles and razor wire.
"Ok, maybe not today. Maybe not next week. Maybe not even next year," he said. "But how long can they protect it? Forever? We will be back in the center of the capital someday."
The storming of Pearl Square by security forces in late February was the first major bloodshed of the unrest. Since then, more than 30 people have been killed.
"All clear," said one of the protesters in the house. "Let's go."
The group slipped out and moved through the darkness of 443 Lane. Someone had just spray-painted a fresh stencil of the tripod-shaped Pearl Square monument, which was razed by authorities after they took back control of the area.
The protesters moved to another building's rooftop to regroup with others before making another run at the police.
They pressed against the walls as a police helicopter passed low overhead. A few blocks away, a store was burning. The smoke was picked up by the wind and carried toward the brightly lit skyscrapers in Bahrain's business district.
