Facebook shares post biggest single-day gain

(AP) ? Facebook's stock is seeing its biggest single-day gain since it began trading in May ? a sign that the social media company's complicated relationship with Wall Street has finally hit a bright spot.

It's been a rough five months, and it's too early to tell whether investors' optimism is here to stay. But on Wednesday they latched on to clear signs of growth in the company's third-quarter earnings report. Several analysts upgraded the stock.

Besides posting quarterly results that inched past Wall Street's expectations, Facebook also gave details for the first time on how much money it made from mobile ads. This has been a concern since before its initial public offering. Although the majority of 1 billion people who use Facebook each month now access it using a mobile device, the 8-year-old company was created in the age of desktop computers, for Web pages. Facebook now calls itself a "mobile-first" company, but it only started showing mobile ads earlier this year.

On Tuesday, Facebook said that nearly $153 million of its $1.26 billion revenue came from mobile advertisements. The rate of advertising revenue growth also accelerated since the second quarter.

Shares of based Facebook Inc., based in Menlo Park, Calif., rose $4.34, or 22.3 percent, to $23.84 on Wednesday. It's by far the stock's biggest one-day gain since Facebook went public on May 18. The stock is still down 37 percent from its $38 initial public offering price.

In his upgrade of Facebook, Citi Investment Research analyst Mark Mahaney said that for the first time since the IPO, investors see a reasonably priced stock combined with accelerating growth at the company. He raised his rating to "Buy" from "Neutral" and increased his target price to $35 from $30.

The analyst noted that advertising revenue grew at a faster pace at Facebook at a time when rival Google Inc. saw a slowdown. Google surprised investors last week with weaker-than-expected earnings report that showed its ad revenue growing at the slowest pace in three years.

Tuesday's strong report doesn't mean that Facebook is out of the woods. The company has looming expiration dates for lock-up periods that have prevented most employees from selling their shares. If shares flood the market as the lock-ups expire later this month, on Nov. 14 and on Dec. 14, Facebook's stock price could decline once again.

20 Percent Of Consumers View Online Streaming As ... - internet TV

The plot continues to thicken for analysts who are beginning to argue if online television is really going to replace traditional cable and satellite television providers in the United States. According to a new study from ABI research nearly 20 percent of online consumers now consider online video as a quick and easy replacement for pay TV.

Streaming TV luring Pay TV customers

That figure amounts to nearly $16.8 billion at risk for satellite and cable providers if more subscribers turn into cord cutters. ABI Research claims that traditional pay TV in the household will decline about half a percent every year through 2017 as online video and affordable (yet premium) subscription based online video streaming services improve and get more advanced.

?While many OTT services focus on movies, the goal of lightweight pay-TV packages should be to introduce customers to the brand and tease customers with premium content offerings,? says Sam Rosen, Director of TV and Video at ABI Research.

ABI argues that traditional pay TV operators, from cable to satellite need to build their businesses utilizing online video and what he calls over-the-top video experiences to draw consumers back into the fold. This could mean providing a mobile or tablet app free of charge for current subscribers?similar to watch HBO is doing with their HBO Go app.

For those who are still clinging to their traditional cable or satellite TV, the companies have a built-in marketing advantage. But for those consumers who have simply moved on from Pay TV and would rather get their television for free via website streams or through drastically more affordable online streaming subscriptions, the traditional Pay TV companies are going to have an uphill battle.

Mexico takes measures to strengthen banks

The Financial Stability Council, or CEF, which is made up of representatives from the Finance Secretariat, the Bank of Mexico and other agencies, said rules issued Oct 10 limited the operations of multi-branch entities with "persons with relevant links".

"These rules complement the measures taken by Mexican authorities to safeguard the financial system from the situation in countries where banks operating in Mexico are headquartered," the CEF said in a statement.

The rules, which took effect the day after they were published, require prior authorization from the Bank of Mexico for executing "significant transfers of assets and other operations between the bank and its related parts", the CEF said.

The 22 financial groups operating in Mexico had total assets of 5.99 trillion pesos ($457.32 billion) as of June 30.

The largest banks operating in Mexico, by assets, are BBVA Bancomer, a unit of Spain's BBVA; Banamex, a subsidiary of US-based Citigroup; Santander Mexicano, a unit of Spain's Santander; Banorte, which is controlled by Mexican interests; and HSBC de Mexico, a unit of London-based HSBC Holdings plc.

So far we've had the opportunity to review the global edition of the Samsung Galaxy Note II -- as well as get our hands on three of the five variants known to be making their way to the US -- but tonight we got our first official look at Verizon's particular flavor. Not that it's much different than the rest of the crowd: it's loaded with the same specs we've seen on the N7000 model (5.5-inch HD Super AMOLED display at 1,280 x 720, 3,100mAh battery and a quad-core Exynos processor clocked at 1.6GHz), with the exception of Verizon-specific LTE bands, and have the same button layout that we've come to expect. Of course, there's that hideous Verizon logo on the main button, but that's the only visual difference we could spot.

Software-wise, Verizon's version of the Note II contains the built-in apps we've gotten accustomed to with its Android phones: VZ Navigator, My Verizon Mobile, and Mobile Hotspot. The device we picked up was running Jelly Bean, like its counterparts from other carriers. Sadly, no pricing or availability is yet available for the Note II on Verizon, with reps at the Samsung event we're at saying that it's up to Verizon to loose that news.

dizzy spell ? Six Things I Learned from ?Sailor Moon?

?Sailor Moon? ? both the adapted anime and the original manga (albeit translated) ? entered my life exactly when I most needed it: during my middle school years. Everyone can relate to coming of age; the fear, the confusion, the anticipation of what?s to come, and will my crush finally notice me? It?s a time when kids can feel extremely anxious or self-doubting, because everyone is going through crazy hormone changes and nothing seems to make sense, no matter how much our superiors promise us for the future. I think it?s a fear of the Unknown ? caused by this great change we go through ? so it?s important to have something to depend on. Friends. Family. ?Sailor Moon.?

It?s now been well over ten years since the television show first came into my life, but it remains a huge part of me. The bond I shared with ?Sailor Moon? and the knowledge it gave me to help shape myself was tremendous ? and vital. I could never negate the imprint it left on me. I could never not consider it an important aspect of my life. And with re-translated manga and a new television series coming in the summer of 2013, I?ve sort of been thinking about it a lot lately. So, now: a tribute, to a pop culture phenomenon that helped make me, me. Here are the six things I learned from ?Sailor Moon.?

Value your friendships.

When I first got into ?Sailor Moon,? I was a part of an inseparable group. There were five of us ? just like the five sailor senshi (or scouts, for those English anime fans) ? and we were so close, sometimes they seemed like family. In fact, as an only child, I considered my very best friend my sister because we hung out together so often. We did everything together, the five of us. And by ?everything,? I mean we?d haunt the Gardens Mall and prowl the DuBois Park at every opportunity ? the gist of activities for girls our age in Palm Beach.

If there?s one lesson that strings ?Sailor Moon? together, it?s the power of love. Sometimes it?s a romantic love, but the series focused a lot on the friendship between the five inner senshi. They made sacrifices for each other. They depended on one another. When they were a team, they knew they could achieve great things. Together they would laugh and cry, send encouragement, and serve as the inspiration for each one to reach their potential. It?s funny (in a sad way) how rare it is to see strong, beautiful friendships between women depicted in any form of fiction. There?s so much cattiness or overbearing talk of boys that gets in the way. And although the relationship between the five girls is not always perfect, you know ? at the end of the day ? that they?re always there for each other. And a little loyalty can go a very long way.

Being imperfect is okay.

I know it?s typical to have a clumsy heroine, but Usagi ? a.k.a. Sailor Moon herself ? had more ?imperfections? than that. She would practically binge whenever stressed out. She was perpetually late; like it was a disease she couldn?t shake off rather than a bad habit. She typically did not perform well in school. She was short. Her friend, Minako (a.k.a. Sailor Venus, a.k.a. who I wanted to be when I grew up & I still haven?t recovered from it not happening), had a hard time balancing her passions with her obligations. She was also incredibly, ironically, unlucky with love. Rei was hot-headed (no pun intended). Even so, these afflictions never set the girls back. If anything, I think it caused them to focus more and try harder.

I am not a perfect person. (Who is?) In my younger years, I wanted someone to admire who was flawed yet cool ? even if that someone was an anime cartoon. Like Usagi, I was (and still am) short. I had braces and even had to wear a ghastly headgear at night. My math skills were little to nonexistent. It?s really easy to focus on aspects of you that you don?t like or things you?re not good at. What ?Sailor Moon? taught me was to flip it around and celebrate what you excel at doing. Alright, Usagi might trip over her tiny legs while shoving a pork bun in her mouth and being late for school, but she was the most caring person you could ever meet; she had a heart of gold. She could adapt to any situation. She could relate to anyone. She was very human, flaws and all. And so was I. Where I lacked in some fields, I was awesome at others: my martial arts background, the respect for teachers (including our science teacher, whom no one liked or was kind to)? I even prided myself on being the only agnostic to graduate middle school, which was kind of a big deal considering it was a Catholic school. I knew it meant thinking critically, and that differing myself from the pack was incredibly human. That?s what ?Sailor Moon? always taught: being the best version of yourself.

Don?t underestimate women.

I didn?t grow up thinking women were weak creatures or anything. I thought my mom was awesome, because she is, and my closest friends were all strong females. Still, it?s hard to avoid the inundation of how women are handled in the media. We?re often touted as being subservient, bitchy, romance fodder, fodders of romance, belonging to the kitchen, or any other host of vicious stereotypes ? including weakness. It?s our duty to be the fine, fair friends of those burly, righteous men whose purpose is to take care of us? right? Wrong.

The women in ?Sailor Moon? get shit done. It?s not always easy and it?s not always grand, but they are all hard-working individuals who have a mind to see their goals realized. Even the baddies ? and there are a lot of villainesses in the series ? have an admirable strength to them. Of course, I didn?t need that taught to me, really. In middle school, I had obtained a brown belt in taekwondo and even sparred with Olympian silver-medalist, Juan Moreno. I was actually so good at sparring that my instructors wanted me to compete on a national level! So while ?Sailor Moon? didn?t teach me that women specifically could kick ass (especially little women), it did reenforce the power inherent in all of us. Physically, and mentally. Especially when we?re fighting for a cause we believe it ? whether through brute force or compassionate outcries ? we ladies seriously kick ass.

Love knows no boundaries.

Growing up, I really didn?t have any contact with anyone in the LGBT community. To my knowledge, none of my parents? friends were gay/lesbian. I have no gay/lesbian family members (perhaps unbelievable, but my family is also very small). No one at my school identified as such at the time, which was understandable, considering our age; now, I know a few of us came out batting for the other team (or both teams). Needless to say, my exposure to ?queerness? at a young age was very, very minimal. It was limited to the media, which can be a terrifying prospect. Terrifying? unless you?re into ?Sailor Moon.?

Unfortunately, the English adaptation of the anime series does take out a lot of the same-sex relationships. Fortunately, I was so into the show that I would actually download the Japanese episodes ? with English subtitles ? and enjoy them as they were meant to be enjoyed. There, nothing was watered down. Michiru (Sailor Neptune) and Haruka (Sailor Uranus) were no longer cousins; they were in a very loving, devoted relationship. It wasn?t explicit; just pure and honest and beautiful. As a kid, they were my first exposure to lesbians, and I thought they were really cool (I especially admired/also wanted to be Michiru). Beyond them, the first couple I actively ?shipped? was a? well, half-lesbian couple. Let me explain: Seiya (Sailor Star Fight) was born and identified as a woman on her home planet; however, upon coming to earth, she and her two mates transformed into men, formed a band, and sought to seek out their Princess via popular song. (I know it?s weird. It?s anime we?re talking about here, so don?t act surprised). Seiya?s relationship with Usagi was some of the best stuff to come out of the entire series. Although most of their interaction happened when Seiya was a man, I desperately wanted them to work their problems out and be together. To me, Seiya?s sex didn?t matter at all. It was her love and devotion to Usagi ? not to mention their chemistry, laden with laughter ? that spoke to me most. Remember: Seiya might have hid her identity while on earth by switches sexes, but her gender (as far as I know) was always female. She identified as a woman. She loved as a woman. And I wanted her and Usagi to have a happy ever after together. Sex and gender didn?t matter if two people were (/are) in love.

The power of creation.

I?ve always been a ?creative? child, drawing and even reading/writing at every opportunity. At my parents? dental lab, I would watch The Lion King on repeat and draw my version of film cells with pastels; still images taken from any random scene throughout the movie. In elementary school, my favorite part of the day was art class and the after-school crafts program I enrolled in every semester. I don?t remember how old I was when I wrote my first short-story, but I do remember it was about being lost in a cave. Later on, I wrote a longer (yet-still-short-)story about a feral child living in the woods. But it was ?Sailor Moon? that ignited my passion. It was the first instance of me not just dipping my toes into the sea of creative writing but bathing in it.

Actually, ?Sailor Moon? tossed me into full fandom mode in general. I was constantly drawing characters, creating my own (Sailor Star Kiss!), and watching fan videos self-published on questionable free web hosts (before the age of YouTube) while wishing I had the talent to do similarly. I was writing fan fiction, including one that was written in a screenplay format and another that was a long-running, multi-chapter story. Both of them featured Usagi/Seiya as the main players, though I could not even begin to tell you what either plot was anymore. (All I remember about the ?screenplay? was a scene at a movie theater, and that it was so absurdly plotted that it probably read like a soap opera. Luckily, I never published that one; however, the series was ? and could still be ? online somewhere.) From ?Sailor Moon? onward, I don?t think I?ve ever stopped writing. I?ve taken breaks here and there, of course ? including two entire years after graduating college with a writing & literature degree ? but it?s always remained close; it?s always on my mind. ?Sailor Moon? not only encouraged me to be creative and to explore my talents, but it taught me of the responsibility that comes with it. Words hold a lot of power, and it?s my duty to use them for great purposes.

Live your dream and don?t give up.

If at first you don?t succeed, try, try again. Just last week, my life felt littered with disappointment. A job rejection email caused me to be crestfallen because it was 100% my responsibility to deliver and sell myself. For an entire day, I wallowed and wept and felt sorry for a girl ?going nowhere.? At one point, I pulled up my blog, cracked my knuckles to ready myself for an inane ramble about feeling inadequate, but ultimately opted to shut down instead. [System failure.] Applying to jobs and getting regularly turned down is tiresome enough, but it really does put a heavy weight on your shoulders. The thing is, though, that you can?t let it keep you down. Although I spent a majority of that Thursday making like a hermit, by the end of the day? I was scouring the web for internships yet again, knowing that I needed to severely beef up my r?sum? if I wanted to impress anyone enough to call me in for an interview. I carried that weight, and I made myself stronger for it.

A never-give-up attitude permeated the ?Sailor Moon? series. It didn?t matter the medium; whether the story was being told in comic form or on a television set. Language was not a barrier, but a carrier of values and lessons ? and inspiration. How many times did the sailor senshi sense defeat throughout 200 episodes or an entire manga series? I can tell you, at least during every Big Battle, there was a moment of doubt: ?Can I conquer evil?? ?Can I save my friends? the world?? ?Do I have it in me to be a hero?? Sometimes the five girls faltered. Sometimes they even died. Sometimes, in desperate measures or in those times when they also felt inadequate (we all have those moments), they would temporarily step back and forfeit. But conceding is not an answer? not for them and not for me. When Sailor Moon was in trouble, she found the means to press forward again. At times that meant waiting for someone to lend a helping hand, or talking out a resolution, but I think it mostly only required her to look within herself.

The beauty of ?Sailor Moon? and an aspect that makes me cherish the franchise to this day is how relatable it was. Every person on this planet has experienced failure; we?ve felt regret; we?ve questioned whether or not we have the strength to carry on. Here is the simple truth: we do. Within all of us, there is an unspoken ability to achieve great things. In one episode, Minako entered an idol competition to see if she had what it took to be a pop superstar ? and she did. It was something she almost missed out on trying because of doubts, but (because of her friends? insistance) she learned that she had the potential to make her dream come true. ?To realize your dream is important,? she said. Going after something you?re passionate about can often be risky, but isn?t that risk worth it? What if you never try and instead give up? How do you know what could have been? If you admit defeat and do nothing to better yourself, you?re going to rot in stagnancy. Instead, rise up and make a name out of yourself. Work hard, even if it?s on small levels? like me now looking for unpaid internships, despite being a college grad, because I know it?ll help me improve myself. Eventually, the efforts should pay off in some way. Know that you?ll always have a dream to chase, even if it changes over time or (if you?re lucky enough) you already reached it. Carpe diem, every day.

?Sailor Moon,? always about second and third and forth chances. Always about being true to yourself. Always about being honest, kind, and loving. Always about being a fighter. Always about encouraging dreamers to dream. If you think you can do it, you probably can, so never allow yourself to give up. Try, try again? just like me, just like my fight for Pixar.

Apple unwraps mini-iPad to take on Amazon, Google

SAN JOSE (Reuters) - Apple Inc will begin to sell an 8-inch version of the iPad on Friday to compete with smaller tablets including Amazon.com Inc's Kindle, but set a higher-than-expected price tag of $329 that Wall Street fears could curb demand.

The 7.9 inch "iPad mini" marks the iPhone-maker's first foray into the smaller-tablet segment. Apple hopes to beat back incursions onto its home turf of consumer electronics hardware, while safeguarding its lead in a larger tablet space that even deep-pocketed rivals like Samsung Electronics have found tough to penetrate.

Apple Chief Executive Tim Cook and marketing chief Phil Schiller took the wraps off the new tablet, which essentially has most of the functions and features of the full-size iPad but in a smaller package.

Priced at $329 for a wi-fi only model, the iPad mini is a little costlier than some predicted, but some analysts see that as a bid to retain premium pricing levels. Others fear the gadget will lure buyers away from the $499 flagship 10-inch iPad, while proving ineffective in combating the threat of Amazon's $199 Kindle Fire and Google's Nexus 7, both of which are sold at or near cost.

"Apple has always been a premium hardware manufacturer. It's basically a hardware company and they don't have Google advertising or Amazon's online store to fall back on," said Destination Wealth Management CEO Michael Yoshikami.

"But people are happy to pay a premium because it's quality hardware, and the ecosystem (of content and apps) cannot be underestimated."

The focus on growing competition was evident as Schiller -- at a launch event held in San Jose's California Theatre -- compared the iPad mini with Google's popular 7-inch Nexus 7 tablet, citing feature by feature why the new Apple device was superior. It is unusual for Apple to single out a specific competitor in its product launches.

"Theirs is made of plastic," Schiller said, referring to the Android tablet. "The entire Android product is thicker and heavier."

In a surprise move, Apple also announced a fourth-generation full-sized iPad just six months after unveiling a third generation device to much fanfare. The latest tablet, which again goes for $499, is faster and slimmer and comes just days before Microsoft is due to show off its own "Surface" tablet.

Wall Street analysts have said for months Apple was planning a less expensive version of the iPad to squash cheaper rival devices, a move they say might hurt its margins but prevent its rivals from dominating an increasingly important segment.

"It's coming in the range that most were grumbling about and that, quite frankly, we're a little bit concerned about," said JMP Securities analyst Alex Gauna. "It's a little confusing at this juncture to try and figure out how it fits into the line-up. Is it going to cannibalize the more expensive iPad?"

"It is worth noting that there are zero-margin products out there competing with them now ..., and that is presenting some challenges to Apple."

Apple's shares ended regular trading down 3.2 percent at $613.36, after gaining 4 percent on Monday in the run-up to the event.

SIGHTS ON AMAZON

The original iPad was launched in 2010 by late Apple visionary Steve Jobs and went on to take a big chunk out of PC sales, upending the industry and reinventing mobile computing with its apps-based model, often called an ecosystem.

A smaller tablet is the first device to be added to Apple's compact portfolio under Cook, who took over from Jobs just before his death a year ago.

"It's very cool," Cook said of the iPad mini. "We told you earlier this year you would see some incredible innovation from Apple across the year. We think we kept our promise."

In a rarity for a company that tightly controls events, Apple live-streamed its invitation-only presentation to Apple devices such as the iPad and Macintosh computers.

Amazon's Kindle and the Nexus 7 have grabbed a chunk of the lower end of the tablet market and proved demand for a pocket-sized slate exists. That has forced Apple into a space it has avoided and at times derided, analysts say.

Apple's chief rival in the smaller-tablet arena is Amazon, which proved a 7-inch tablet at around $200 has consumer appeal. The Kindle Fire, released last year for $199, was one of the hottest-selling holiday gadgets. It pressured Amazon's margins but gave it potentially millions of new high-spending customers.

Amazon sold more than a million Kindles a week during December, paving the way for others like Google with its Nexus 7 to try and beat Apple in a market the company created.

The Internet retailer has now put its second-generation Kindle Fire HD on the market, which it says is the "best-selling product across all of Amazon worldwide," based on undisclosed U.S. sales figures and international preorders.

Google's Nexus 7 tablet, built by Asian manufacturer Asustek, quickly ran out of stock after its July launch.

All three companies will be vying to get their devices on shopping lists during the U.S. holiday season, which traditionally starts next month.

Surveys conducted ahead of Tuesday's news suggested some consumers had hoped for a more affordable mini tablet.

The "starting sweet spot" for the tablet would be in the $249-$299 range, according to a survey of more than a thousand consumers by Baird Equity Research.

"When asked what the most they would pay for a smaller iPad was, our respondents on average said that they would pay $242 for a 7-inch iPad and $268 for an 8-inch iPad," said William Power, Baird Equity Research analyst.

PRICE IS KEY

Jobs famously derided the 7-inch screen, saying such a device should come with sandpaper so users can file down their fingers. But an internal email revealed during a patent trial showed he turned more favorable to the idea by early 2011.

Apple has sold 100 million iPads so far, with the device accounting for 26 percent of Apple's fiscal third-quarter revenue.

But analysts are concerned now about erosion of Apple's industry leading margins as it takes on the Kindle Fire. It earned gross margins of 23 percent to 32 percent on U.S. iPad sales between October 2010 and the end of March 2012, according to a July court filing by Apple.

Rivals haven't fared as well. Amazon's first Kindle Fire just about breaks even, according to IHS iSuppli estimates, and Google has said its Nexus 7 is being sold at cost.

"The pricing may limit sales. From a profitability perspective though, I think at $330 Apple is still getting adequate gross margins on the sales," said Morningstar analyst Brian Colello. "But at that price point it may limit adoption and unit volumes."

Italian earthquake case is no anti-science witch-hunt

Manslaughter verdicts for six seismologists highlight the need for scientists to speak for themselves

It is easy to feel outrage at the jail terms handed down to six Italian seismologists and a civil servant this week. How could anyone hope to have predicted the earthquake that devastated L'Aquila in 2009?

That is the rallying cry, but failure to predict the quake is not, in fact, what the seven men have been convicted of. The prosecution made it crystal clear all along that their case was about poor risk communication; it was built on an accusation of giving out "inexact, incomplete and contradictory information".

On this charge, there was clearly a case to answer. Employed by Italy's Major Hazards Committee to assess earthquake risks and communicate them to the government and the public, the seismologists got the science right, but left the job of public communication to a civil protection official with no specialist knowledge of seismology. His statement to the press was, to put it mildly, a grossly inaccurate reflection of the situation: "The scientific community tells us there is no danger, because there is an ongoing discharge of energy. The situation looks favourable." At this point, the seismologists should have stepped in. But they did not, and the message stuck.

Of course, it is debatable whether this neglect merits a manslaughter conviction and six-year jail term. That is a matter for the Italian justice system. The appeals have already started.

But there are broader issues to consider. Many commentators argue that the L'Aquila verdict will have a chilling effect on the provision of scientific advice in Italy and beyond. That is clearly a concern worth taking seriously.

However, it should also encourage scientists who take on those roles to think long and hard about the responsibilities that come with them. It is tempting for scientists to defer communication with the public to others who are supposedly "experts" in doing so. But this approach often leads to confusion, as evidenced by a litany of failures in the past: BSE, vaccines, genetically modified crops and many more.

This cannot continue. Scientists valued for their expertise should speak for themselves rather than letting others speak for them. Lives are at stake.

Cautious Optimism For Real Estate from Agents: Redfin's Real-Time ...

Never content to sit around twiddling our thumbs, earlier this year we set out to supplement the broad real estate market insights we produce every month in our Real-Time Home Price Tracker and Real-Time Demand Pulse, adding even more depth with the introduction of our quarterly homebuyer survey, followed by our quarterly home seller survey. Now, to complete the trifecta, we are proud to introduce the inaugural Redfin Real-Time Agent Survey.

Real estate agents surveyed by Redfin:

  • See now as a good time to buy a home more often than a good time to sell one: 75% of agents surveyed described now as ?a good time to buy,? while only 54% described it as ?a good time to sell.?
  • Mostly expect price gains to be modest: Only 11% of agents expect home prices to ?rise a lot? in the next year. The vast majority?76%?expect prices to ?rise a little.?
  • Are feeling the pinch of low inventory and multiple offers: 90% of agents indicated that low inventory was one of the most common challenges facing buyers, and 91% pointed to multiple offers.
  • Are seeing both buyers and sellers gaining confidence in the market: 85% of agents agreed that buyers are becoming more confident about the market, and 84% agreed that sellers are becoming more confident.
  • Have hope for future of the real estate profession: 59% of agents believe that the real estate profession will grow in size in the next five years, 30% believe it will remain the same, and just 11% see more declines in the future.

The picture painted by the agents is one of cautious optimism. Most agents we surveyed expect modest price gains, improvements for buyers as well as sellers, and moderate growth in the real estate industry. The results line up nicely with recent gains in overall consumer confidence, which has been rising steadily through the year. No V-shaped recovery appears imminent, but rather a slow and steady trend back toward something resembling a normal market.

?That agents believe both buyers and sellers are becoming increasingly confident bodes well for sales volume in 2013,? said Redfin CEO Glenn Kelman. ?Over the past five years, eager sellers have been unable to find a buyer, or more commonly in 2012, eager buyers have been unable to find a seller. But going into 2013, we expect that a jittery market will settle down, and buyers and sellers will more easily come to terms. After years of irrational exuberance, crashes, foreclosure fire-sales, inventory shocks and saw-toothed trends, the cautious, broad-based optimism we?re seeing now is the best kind of recovery we could hope for.?

For one week in September (September 21 through 28, 2012), we surveyed 722 agents around the country, including 323 Redfin-employed agents and 399 Redfin partner agents.

Respondents spanned 19 metropolitan markets in the U.S.: Atlanta, Austin, Baltimore, Boston, Chicago, Dallas, Denver, Los Angeles, New York, Orange County, Philadelphia, Phoenix, Portland, Riverside / San Bernardino, Sacramento, San Diego, San Francisco, Seattle, and Washington DC.

Better to Buy than Sell?

There?s a common perception that all real estate agents will always tell you that ?it?s a great time to buy? or ?it?s a great time to sell,? no matter what?s really happening in the market. Most agents we asked do indeed feel that now is a good time to buy (75%), likely thanks to prices hitting bottom in most markets across the country this year. For the same reason, only about half of the agents we surveyed (54%) feel that now is a good time to sell a home.

Modest Price Gains Expected

So with prices likely hitting bottom this year, are we in for another boom? Most agents don?t think so. The overwhelming majority (76%) expect prices to rise just a little in the coming year.

Agents Battling Low Inventory and Multiple Offers Alongside Buyers

We asked agents who work with homebuyers about the most common challenges they are facing in today?s market, and the response was overwhelming: Echoing what we have been hearing directly from buyers all year, over 90 percent of agents indicated low inventory or multiple offers as the biggest issues for buyers. Facing a market with many short sale and foreclosure listings (which often involve a much higher stress process to buy) and becoming fatigued from the discouraging process of repeatedly having promising homes slip through their fingers were the next-highest challenges with fewer than half as many responses.

Listing Agents Face a Mixed Bag of Challenges

On the flip side, agent responses about the most common challenges for sellers were more mixed. The only response chosen by a majority of agents was ?unrealistic expectations? at 53 percent. Although prices have been on the rise for most of the year, it seems that sellers may have a more optimistic view on pricing than most agents.

Confidence, Aggression on the Rise Among Buyers

Agents overwhelmingly agreed with statements that both buyers and sellers are getting more confident (85% and 84%, respectively), and an equally large number (85%) are seeing more aggressive offers from homebuyers as they respond to the difficult realities of today?s market.

Two thirds of agents agreed that sellers are ?frequently accepting all-cash offers, even for less than a financed offer.? This preference from sellers is likely related to another common issue we have heard: appraisals are frequently coming in below the contract price. Over half of agents (57%) agreed that this is an issue they have seen in their market.

A Rosy Future for the Real Estate Profession?

With the number of real estate agents having been shaved by the hundreds of thousands over the last few years, we asked agents whether they saw a turnaround for the industry now that the market is beginning to slowly rebound. Just over half of respondents (56%) expect a modest rise for the real estate agent profession over the next five years, while 30% expect things to remain roughly the same as they are now.

FMLA damages are payroll taxable, court rules ? Business ...

For a long time, damages employees received under the FMLA weren?t considered payroll taxable because courts read the FMLA?s unique damages provision?which mandates damages equal to lost pay?as not being the same as taxable back pay. A federal trial court has now turned this reasoning on its head and ruled that FMLA lost-pay damages are, indeed, subject to income and FICA taxes. (Cheetham v. CSX Transportation, No. 3:06-cv-704-J-PAM-TEM, D.C. Fla., 2012)

Damage assessment

A jury awarded an employee $265,655 in total damages for wrongful termination under the FMLA, $199,056 of which was attributed to lost wages. The issue was whether the employer should withhold payroll taxes from the award.

The employee said no, relying on those prior cases. The employer said yes, pointing to tax penalties for failing to withhold.

The trial court, caught between the two, did something the other courts never did: It asked the IRS to weigh in on the matter by filing a friend-of-the-court brief.

The IRS, of course, concluded that damages for lost wages were subject to withholding, and that the employer would be liable if it didn?t withhold. That was enough for the court.

Court: The FMLA?s damages provision states that an employee may receive three types of damages: lost wages or actual monetary damages, interest and liquidated damages. The most logical interpretation is that ?damages equal to lost wages? acknowledges the fact that three amounts can be added together to arrive at a total award, not that damages equal to lost wages are unique and not subject to payroll taxes.

PAYROLL PRACTICE TIP: When analyzing a back pay award under any employment law, look at the allocations for back pay, compensatory damages, attorneys? fees, etc. Next, determine whether the company is liable for the entire award or whether managers are individually liable. Amounts attributable to lost wages, which is corporate liability, are subject to withholding. Amounts attributable to managers? liability may be taxable, but aren?t subject to withholding.

MEXICO CITY (AP) -Toluca defeated reigning champions Santos Laguna 4-1 on Sunday to take the Mexican league lead with just three rounds remaining.

Tijuana is in second place, level on points with Toluca but behind on goal difference, after drawing 2-2 against Cruz Azul on Friday. Leon remains third despite losing 2-1 to America on Saturday.

In other games, Tigres defeated Pumas 5-0, Pachuca drew 1-1 with Monterrey, Morelia won 2-1 against Queretaro, San Luis overcame Atlas 3-2, Jaguares defeated Puebla 2-0 and Atlante won 3-1 against Chivas.

Wilson Matias and Antonio Rios put Toluca two goals up before Edgar Benitez was sent off in the 31st minute for a reckless challenge.

Saints linebacker Jonathan Vilma has borrowed, sort of, the punch line to the old joke about a busload of lawyers at the bottom of the ocean when commenting on the decision of Commissioner Roger Goodell to hand the bounty appeal baton to former Commissioner Paul Tagliabue.

?It?s a good first step,? Vilma told Jeff Darlington of NFL Network, ?for Paul to be the neutral arbitrator.?

The key word is neutral.? If Vilma?s lawyer, Peter Ginsberg, and/or the NFLPA believe that Tagliabue won?t be neutral, then it will be a problem.

?We expect that [Tagliabue will] do things in a neutral capacity that will allow us to cross examine some of the witnesses,? Vilma said.? ?See some evidence.?

The reality is that Ginsberg and Jeffrey Kessler, the primary NFLPA outside counsel, will refrain from taking any position on Tagliabue until having a chance to hear from Tagliabue regarding his plan for the October 30 appeal hearing.? If they get the sense that Tagliabue won?t be neutral, objective, and/or impartial, they?ll likely fight the appointment.? If they like what they hear, they possibly will accept Tagliabue as the arbitrator.

It?s smart lawyering.? Why complain without getting a chance to take Tagliabue?s temperature?? If, for example, he says that key witnesses like former Saints defensive coordinator Gregg Williams and former Saints assistant Mike Cerullo won?t be required to testify, then they?ll know to fight the appointment.? If, alternatively, they get the impression based on Tagliabue?s comments that he plans to require the league to prove its case, they may overlook factors that otherwise would cause them concern.
